Specification: In that Private John F. Day, U. S. Army, Company F, 998th Infantry, did, at Fort Amherst, Ohio, on or about 9 November 1956, unlawfully strike Private John P. Snooker on the face and body with his fists.
Charge II: Violation of the Uniform Code of Military Justice, Article 134.
Specification: In that Private John F. Day, U. S. Army, Company F, 998th Infantry, having been duly restricted to the limits of Fort Amherst, Ohio, did, at Fort Amherst, Ohio, on or about 10 November 1956, break said restriction.

Pvt John P. Snooker, Co F, 998th Inf, will testify in substance as follows: On Saturday afternoon, 9 November 1956, I went to sleep on my bunk in the barracks. At that time no one else was in the squadroom, but when I woke up I couldn’t find my wrist watch. Private Day was lying on his bunk two beds down the aisle. While I was asking him whether he had seen my watch, he unexpectedly hit me in the face and on my body several times with his fists and made my nose bleed. I didn’t try to strike him back until my nose started bleeding. The next day both my eyes were blackened, and the doctor at the dispensary gave me some medicine.
